1.0 In these terms and conditions the local authority shall mean Pembrokeshire County Council and the Web Advertiser shall mean the person who completes the online signup form and whose order is accepted and pays the relevant advertising fee.
1.1 These terms and conditions shall apply to all contracts for web advertisements accepted for inclusion online to the exclusion of all other terms and conditions including any terms or conditions which the Web Advertiser may purport to apply under purchase order, confirmation of order or similar document.
1.2 Any variation of these terms and conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the local authority.
2.0 The Web Advertiser warrants that the advertisement does not in any way contravene the provisions of the Trade Descriptions Act 1968, the Consumer Protection Act 1987, nor any other relevant legislation nor the code of Advertising Practice. The Web Advertiser hereby agrees with the local authority that whereby reason for the local authority’s default, any errors occurs in or in relation to an entry on the web site www.visitpembrokeshire.com or there is any omission there from in respect of any entry the local authority’s liability whether under statute or in common law for liability or negligence, breach of contract or otherwise shall under no circumstances exceed the amount of the total entry fee and no liability shall attach to the local authority in respect of consequential loss.
2.1 If the Web Advertiser is entitled to compensation in respect of the local Authority’s limited liability any such claim must be made in writing to the local authority within one month of publication of the web advertisement.
2.2 Web Advertisers on the local authority web site www.visitpembrokeshire.com must agree to their premises being verified by either Visit Wales or AA approved inspectors.
2.3 A separate charge will be made for Visit Wales verification (if 10/11 fee is not already paid). Further details of the verification scheme can be obtained from Visit Wales – 03000 622419
a) All serviced accommodation must comply with at least the minimum standard of the Visit Wales or AA Classification scheme or Awaiting Grading
b) All self-catering accommodation must be graded by a Visit Wales or AA approved inspector or at least Awaiting Grading.
c) All caravan holiday home parks and touring caravans and camping parks must be graded by a Visit Wales or AA approved inspector or at least Awaiting Grading
d) All advertisements must display the grading symbol awarded by Visit Wales or AA.
2.4 Web advertisers will be required to maintain their Visit Wales or AA verification for the whole period of their advertisement. Failure to renew verification will lead to the advertisement being removed from the website.
2.5 Advertisments will only be accepted from tourism businesses operating in Pembrokeshire.
2.6 Advertisments from tourism businesses operating very close to Pembrokeshire, where visitors are likely to associate the proximity to Pembrokeshire as a significant reason for choosing that business, and whose guests are likely to spend a significant proportion of their stay in Pembrokeshire, will be accepted. An approximate maximum distance of 5 miles from the Pembrokeshire county boundary will be applied.
3.0 Entries are accepted subject to copy and jpeg images being in accordance with the standards of the web site www.visitpembrokeshire.com produced by the local authority.
3.1 All web advertisements featuring holiday prices must be inclusive of VAT at the prevailing rate.
3.2 Price information provided for inclusion on the www.visitpembrokeshire.com web site must comply with the Consumer Protection Act 1987 - Misleading Price Indication, whereby it is an offence to give any consumers a misleading price indication relative to goods, services, accommodation or facilities. Price information provided must be honoured for the duration of the web advert.
3.3 The web advertiser must amend price information before price changes come into operation.
4.0 No liability is accepted by the local authority for the failure of the web advertiser to update information on their own advertisement.
4.1 The web advertiser shall indemnify the local authority against any claim directly or indirectly arising in connection with or as a result of the web entry.
4.2 The local authority expressly reserves the right to refuse to publish a web entry without assigning any reason whatsoever.
4.3 The local authority reserves the right to change or amend any advert details without prior consultation with advertisers. The council will endevour to retrospectively advise advertisers of any changes and the reason for making changes.
4.4 Web advertisements are accepted on the understanding that where maps or illustration, based directly or indirectly on Ordnance Survey material, are
used in the advertisement, the web advertiser has sought and obtained permission from the Ordnance Survey for such use and agrees to pay directly Ordnance Survey any royalties due under the current terms and conditions set out in the Ordnance Survey publications.
4.5 Web advertisements are accepted on the understanding that all information and descriptions are correct, and descriptions are not likely to mislead, as to the nature of any services, accommodation or facilities provided.
4.6 The local authority reserves, at its absolute discretion, the right to omit or amend any advertisement.

6.0 Cancellations - Web advertisements may be removed following a written request, however the advertisement charge is non refundable.
